PurvX India Terms and Conditions
Effective Date: 19 July 2025
OVERVIEW
This website is operated by PurvX India. The terms “we”, “us”, and “our” refer to PurvX India. These Terms and Conditions (“Terms”) govern your access to and use of www.purvx.in and all related features, tools, services, and systems provided by PurvX India (collectively, the “Platform”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy, Return and Exchange Policy, and Seller Guidelines. If you do not agree with any part of these Terms, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and PurvX India. Additional definitions, legal references, and platform-specific conditions are set out in the sections that follow.
We reserve the right to update, amend, or modify these Terms at any time without prior notice. You are responsible for reviewing them periodically to remain informed of any changes. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
These Terms contain important information about your legal rights, disclaimers of warranties, and limitations of liability. Please read them carefully before proceeding.
SECTION 1 – DEFINITIONS
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below. These definitions apply whether the terms are capitalised or not.
· “Account” means a registered user profile created to access and use certain parts of the Platform, including listing Items or placing orders.
· “Buyer” means a User who purchases Items listed on the Platform.
· “Business Seller” means a Seller who is engaged in the commercial sale of goods and has registered as a business, including but not limited to sellers registered with a GSTIN or operating under a trade name.
· “Commission” refers to the percentage of the final sale price that is retained by PurvX India as a service fee when a listed Item is sold.
· “Content” refers to any text, images, photographs, videos, data, ratings, comments, reviews, communications, or other material posted, uploaded, or shared by Users or by PurvX India on the Platform.
· “Individual Seller” means a Seller who is acting in a personal, non-commercial capacity and is not registered as a business entity.
· “Items” means any new or preloved ethnic clothing, accessories, home decor, or other tangible goods listed by a Seller on the Platform.
· “KYC Information” refers to identity, tax, or business verification details required under applicable Indian laws and platform policies, including but not limited to PAN, Aadhaar, GSTIN, and bank account information.
· “Listing” means any Item made available by a Seller on the Platform for sale, including all associated information such as descriptions, pricing, images, condition, and other metadata.
· “Listing Fee” refers to the non-refundable fee charged by PurvX India to the Seller in order to publish an Item for sale on the Platform, based on the pricing tier applicable at the time of listing.
· “Payment Processor” means any third-party service provider authorised by PurvX India to facilitate payments, refunds, or transfers, including UPI gateways, card networks, net banking, wallets, or other modes of payment.
· “Platform” means the website www.purvx.in, including any of its subdomains, mobile applications, seller dashboards, content management tools, forms, and other digital interfaces or systems owned, operated, or managed by PurvX India or its service providers.
· “Preloved” refers to any Item that has been previously owned, regardless of whether it has been worn or used.
· “Products” has the same meaning as “Items” and may be used interchangeably in these Terms.
· “PurvX India” refers to the business entity operating the Platform, including its representatives, affiliates, licensors, and service providers.
· “Seller” means a User who lists or offers Items on the Platform for sale.
· “Services” refers to all features, tools, content, and support provided through the Platform to facilitate the listing, discovery, purchase, and sale of Items.
· “Terms” means these Terms and Conditions, including any policies, guidelines, or documents referenced herein or published on the Platform from time to time.
· “Third-Party Services” means services, platforms, tools, or applications that are not owned or controlled by PurvX India but may be integrated with or accessed through the Platform.
· “User” refers to any individual or entity who accesses or uses the Platform, including Sellers, Buyers, and visitors.
SECTION 2 - ACCESS AND ACCOUNT
By agreeing to these Terms and Conditions, you confirm that you are at least 18 years of age or otherwise legally competent to contract under applicable laws in India. If you are accessing the Platform on behalf of a minor, you represent that you are the parent or legal guardian and consent to their use of the Services through devices you own, purchase, or manage.
To use the Services — including accessing or browsing our online store or purchasing any products — you may be required to provide certain information such as your name, email address, billing details, shipping address, and payment information. You represent and warrant that all information you provide is true, current, and complete, and that you are legally authorised to provide such information.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to sell, transfer, assign, or license your account to any other person. You must notify us immediately of any unauthorised use or suspected breach of your account.
SECTION 3 – LISTINGS AND ITEMS
PurvX India is a peer-to-peer marketplace that enables independent Sellers to list and sell Items directly to Buyers. All Items are listed, owned, and fulfilled by individual Sellers. PurvX India does not manufacture, own, stock, or sell any Items on the Platform.
Each Listing is created and managed by the respective Seller, who is solely responsible for providing accurate descriptions, condition details, images, and pricing. While we require Sellers to follow our listing guidelines, PurvX India does not guarantee the accuracy, completeness, or authenticity of any Listing.
You acknowledge and agree that:
· The appearance, colour, and condition of Items may differ slightly from how they appear on screen, due to photography, lighting, or display settings.
· Orders are fulfilled by the Seller, who is responsible for packaging, shipping, and delivery.
· PurvX India acts as a facilitator and does not assume responsibility for the quality, fit, or performance of any Item purchased through the Platform.
· Listings may be modified, restricted, or removed by us at any time if they violate platform policies or applicable law, or to protect the integrity of the Platform.
SECTION 4 – PROHIBITED LISTINGS
Sellers are solely responsible for ensuring that the Items they list on the Platform comply with all applicable laws, platform rules, and community standards. The following types of Listings are strictly prohibited and may result in removal, suspension, or permanent banning of the Seller’s Account, without prior notice:
1. Counterfeit or Misrepresented Items
o Items falsely presented as designer, branded, or original when they are replicas or inspired versions
o Use of third-party logos, labels, or brand names without authorisation
o Listings that omit key information (e.g. visible tags, branding, damage) that may mislead Buyers
2. Illegal or Restricted Items
o Items prohibited under applicable Indian law, including goods obtained through unlawful means
o Products containing materials restricted under wildlife, customs, or cultural heritage laws (e.g. ivory, animal skin, antiquities)
3. Offensive or Culturally Inappropriate Content
o Listings that contain vulgar, discriminatory, or culturally insensitive imagery, descriptions, or language
4. Inaccurately Described or Fraudulent Listings
o Listings with knowingly false condition, pricing, or usage details
o Use of manipulated or stock images that do not reflect the actual Item for sale
5. Duplicate or Spam Listings
o Multiple Listings for the same Item without meaningful differences
o Use of misleading titles, excessive keywords, or irrelevant content to manipulate visibility
6. Unauthorised Services or Promotions
o Listings that advertise services (e.g. tailoring, makeup, photography) or promote external platforms, websites, or businesses
PurvX India reserves the right to review, modify, or remove any Listing at its discretion to ensure platform integrity and user safety. We may request additional verification, documentation, or evidence from Sellers before or after a Listing is published.
SECTION 5 – ORDERS
When you place an order on the Platform, you are making an offer to purchase the selected Item directly from the Seller. The Seller is responsible for reviewing, accepting, and fulfilling the order. Placing an order does not create a binding contract until the Seller confirms the order and PurvX India processes the payment on their behalf.
PurvX India acts as a facilitator in the transaction and may, at its discretion, assist in order-related communication or issue resolution. We do not guarantee that an order will be accepted or fulfilled and reserve the right to cancel or restrict any transaction in the interest of fraud prevention, user protection, or compliance with platform policies.
Before placing an order, please review all details carefully, including Item description, images, condition, and Seller information. Orders may not be eligible for cancellation once placed, particularly if the Seller has already begun preparing for shipment.
If an order is cancelled or modified, we will attempt to notify you using the contact information provided at the time of purchase.
All purchases are subject to our Refund and Exchange Policy [LINK]. By placing an order, you confirm that the purchase is for personal or household use only and not for commercial resale or export.
SECTION 6 - PRICES AND BILLING
All Item prices on the Platform are set by individual Sellers and are listed in Indian Rupees (INR). Prices may change at any time at the Seller’s discretion. The price charged will be the amount shown at checkout and confirmed in your order summary.
Unless otherwise stated, listed prices do not include shipping charges, customs duties, or other applicable fees. These may be shown at checkout (where applicable) or may be the Buyer’s responsibility, depending on the Seller’s location and shipping terms.
PurvX India may, from time to time, offer platform-wide promotions or service discounts. Any such offers will be governed by separate terms, and in case of a conflict, the promotional terms shall take precedence.
You agree to provide accurate, complete, and up-to-date billing, shipping, and contact details when placing an order. This includes your phone number, email address, and preferred payment method.
Accepted payment methods include:
· UPI
· Credit and debit cards
· Net banking
· Wallets
· Bank transfers (where enabled)
Payments are processed through authorised third-party payment providers on behalf of the Seller. You will receive an order confirmation summarising your transaction. Most Sellers on the Platform are individual users and may not be registered to issue formal tax invoices. If you require a GST invoice for regulatory or business purposes, please verify with the Seller before placing an order.
SECTION 7 – SHIPPING AND DELIVERY
All Items sold on the Platform are packaged and shipped directly by the individual Seller. PurvX India does not manage or operate any shipping or logistics service and is not responsible for the physical handling or delivery of Items.
Delivery timelines are estimated by the Seller or the shipping carrier and may vary based on the Seller’s location, the Buyer’s address, courier delays, customs processing, or other external factors. Delivery dates are not guaranteed.
You acknowledge and agree that:
· PurvX India is not liable for any shipping delays, losses, or damage that occurs during delivery
· Risk of loss or damage transfers to the Buyer once the Seller hands over the Item to the shipping provider
· The Seller is solely responsible for securely packaging and dispatching the Item after an order is confirmed
Sellers are required to:
· Dispatch the Item within a reasonable time after order acceptance
· Provide valid tracking information once the Item is shipped
· Use reliable courier or postal services with delivery tracking
Buyers are expected to:
· Monitor tracking updates and ensure availability to receive the delivery
· Confirm receipt of the Item once delivered
· Report any non-delivery, damage, or order-related issues within 3 days of delivery
Failure to report issues within 3 days of confirmed delivery may affect eligibility for platform-supported dispute resolution or refund assistance.
PurvX India may, at its discretion, assist in facilitating resolution between the Buyer and Seller, but does not guarantee a specific outcome.
SECTION 8 – BUYER OBLIGATIONS
By accessing or using the Platform as a Buyer, you agree to the following responsibilities, which are essential to maintain a safe and trustworthy marketplace for all users:
1. Provide Accurate and Verifiable Information
You must submit accurate, complete, and current information at the time of account creation and when placing any order, including contact details, delivery address, and payment method. Use of false identities, temporary emails, or impersonation is strictly prohibited.
2. Review Listings and Seller Information Carefully
You are responsible for reviewing the full details of any Listing, including photos, descriptions, condition, and Seller profile before placing an order. PurvX India is not liable for dissatisfaction arising from failure to review the Listing thoroughly. If you require a formal GST invoice for your purchase, you are responsible for confirming that the Seller is GST-registered before placing an order.
3. Timely Acknowledgment of Delivery and Reporting Issues
Upon receiving your order, you must inspect the Item and confirm receipt. Any concerns related to non-delivery, damaged goods, counterfeit items, or material misrepresentation must be reported to PurvX India within three (3) days of confirmed delivery. Reports raised after this period may not be eligible for resolution or refund.
4. No Commercial Resale Without Authorisation
Purchases made on the Platform are for your personal or household use only. You may not resell Items purchased on PurvX India for commercial gain unless you are a registered business Seller and have written approval from PurvX India.
5. Prohibited Conduct and Platform Misuse
You must not:
o Harass or threaten Sellers
o File false disputes or chargebacks
o Create multiple Buyer accounts to manipulate offers or avoid enforcement
o Use the Platform to launder funds or commit any fraudulent activity
6. Community Guidelines and Platform Integrity
You are required to comply with any community guidelines or usage standards published by PurvX India. These may include acceptable conduct during order disputes, communication etiquette with Sellers, and avoidance of manipulative behavior.
7. Legal Compliance
You are solely responsible for complying with applicable local laws, including any import duties, taxes, or customs restrictions on Items shipped across regions or internationally.
8. Platform Enforcement and Account Action
PurvX India reserves the right to take enforcement action—including warnings, temporary restrictions, or permanent suspension of your Account—if we believe you have violated these Terms, abused platform features, or undermined the trust and safety of the community. We may also report suspected fraud to payment processors or relevant authorities.
SECTION 9 – SELLER OBLIGATIONS
By listing Items on the Platform as a Seller, you agree to uphold the following responsibilities to ensure a fair, safe, and trustworthy marketplace for all users:
1. Ownership and Right to Sell
You represent that you are the lawful owner of each Item listed, or are otherwise authorised to sell it. You may not list stolen, counterfeit, or unauthorised goods under any circumstances.
2. Accurate Listings and Honest Disclosure
You must provide accurate, complete, and honest information for every Listing, including clear images, material facts, condition, any defects, and prior usage history (if applicable).
o Do not misrepresent Items as branded or designer unless verifiably true
o If an Item is inspired by or a replica, it must be clearly labelled as “designer inspired” or equivalent
o Do not use stock images or images copied from other sellers or sites
3. One Item Per Listing
Each Listing must correspond to a single, unique Item. Bulk uploads or multipacks are not permitted unless authorised in advance.
4. Timely Fulfillment and Tracking
You must:
o Ship the Item within a reasonable timeframe after the order is accepted
o Provide valid tracking details once shipped
o Use a reputable courier service with delivery tracking
o Package Items securely to prevent damage in transit
5. Communication and Dispute Cooperation
You agree to respond promptly and respectfully to Buyer or platform inquiries. If a Buyer raises a dispute regarding non-delivery, misrepresentation, or damaged goods, you are expected to cooperate in good faith to resolve the issue.
6. Prohibited Listings and Conduct
You must not list:
o Counterfeit, fraudulent, or misrepresented Items
o Offensive or inappropriate content
o Duplicate or spam Listings
o Services, rentals, or promotional offers outside PurvX India’s approved use
You must not engage in:
o Off-platform transactions or payments
o Manipulation of ratings, reviews, or Listings
o Threats, harassment, or fraud
7. Compliance with Platform Policies and Community Guidelines
All Sellers are required to comply with these Terms, the Seller Guidelines, and the Community Guidelines published or referenced on the Platform. Sellers must also comply with applicable laws, including consumer protection, KYC, and tax regulations where relevant.
8. Platform Enforcement and Account Action
PurvX India reserves the right to remove Listings, restrict account access, withhold payouts, or suspend a Seller’s Account without prior notice if any violations are detected. In cases of suspected fraud or repeated policy breaches, we may escalate the matter to payment providers or legal authorities.
SECTION 10 – SELLER REGISTRATION AND KYC REQUIREMENTS
All Sellers must complete registration and identity verification before they are allowed to list Items on the Platform. PurvX India requires KYC (Know Your Customer) compliance as part of our legal obligations and commitment to platform trust and safety.
1. Mandatory KYC at Registration
KYC verification is required at the time of Seller sign-up. Sellers will not be permitted to list Items or access selling tools until the required KYC process is completed and approved.
2. Individual vs Business Sellers
o Individual Seller: A person listing in a personal capacity, not registered as a business.
o Business Seller: A person or entity operating under a business name, holding a GSTIN, or otherwise selling commercially.
In accordance with Rule 5(3) of the Consumer Protection (E-Commerce) Rules, 2020, Business Sellers are required to disclose their registered business name and provide a valid GST Identification Number (GSTIN) during registration.
3. Required KYC Information
Sellers must provide the following information, based on their seller type:
For Individual Sellers:
o Full name
o Either PAN (Permanent Account Number) or Aadhaar (for identity verification)
o Bank account details or UPI ID
o Contact information and address
For Business Sellers (in addition to the above, where applicable):
o Business name and entity type
o GSTIN
o Registered business address
o Trade name (if different)
4. Verification and Use of Information
PurvX India may verify Seller details directly or via authorised third-party verification providers. KYC information is used solely for compliance, fraud prevention, and secure disbursement of payouts, and is handled in accordance with our Privacy Policy.
5. Ongoing Compliance
Sellers must keep their KYC information and account details up to date. PurvX India reserves the right to re-verify Sellers at any time or request additional documentation based on transaction activity or platform risk assessment.
6. Non-Compliance and Misrepresentation
Submitting false or misleading information, or failing to complete KYC when required, may result in:
o Listing restrictions or removal
o Suspension or termination of the Seller’s account
o Withholding of payouts
o Reporting to relevant authorities or payment partners
SECTION 11 – LISTING FEE, COMMISSION, AND PAYOUTS
PurvX India charges Sellers a non-refundable listing fee and a commission on successful sales. These fees support the operation of the Platform, including listing moderation, promotional services, dispute assistance, and payment infrastructure.
1. Listing Fee
A non-refundable listing fee is charged at the time an Item is submitted for approval on the Platform. Applicable fees are based on the pricing tier of the Item and are shown clearly to the Seller during the listing process. Listings will not be reviewed or published until the applicable fee is paid in full.
PurvX India may, at its sole discretion, offer discounted or custom listing fees to select Sellers or under specific promotional programs. These concessions will be governed by applicable terms, including duration and eligibility.
2. Commission on Sale
A commission is charged on the final selling price of each successfully sold Item and is deducted from the Seller’s payout. If a listing fee was paid, the commission is reduced by the fee amount in accordance with the applicable pricing logic.
Commission rates may vary depending on the Item type, sale price, or applicable Seller concession. Any such terms will be communicated to eligible Sellers and applied as per PurvX India’s discretion.
3. Listing Service Enhancements
Sellers may optionally purchase additional services to boost visibility or reach, including:
o Homepage or featured placement
o Social media promotion
o Search and category boosts
All fees for Listing Service Enhancements are non-refundable, regardless of whether the Item is sold or removed. Availability of such services and pricing will be displayed at the time of purchase.
4. Payouts and Disbursements
Payouts are only made to Indian bank accounts or UPI-linked accounts. Sellers will be required to provide verified payout information after the first successful sale. No payouts will be processed until this information is submitted and verified.
o Payouts are calculated based on the final selling price, minus applicable commission and adjustments.
o Disbursement timelines may vary based on the payment processor’s policies, Seller status, or transaction review.
o Sellers are responsible for providing accurate payout details. PurvX India is not liable for delays or failed transfers due to incorrect or incomplete information.
5. Fee and Commission Updates
PurvX India may update listing fees, commission rates, or service enhancement pricing at any time. Any such changes will apply prospectively and will not affect Listings already submitted and paid for.
6. Non-Compliance or Withholding
PurvX India reserves the right to withhold or delay payouts in cases of policy violations, disputes, chargebacks, suspected fraud, or pending KYC verification. We may also withhold access to promotional services or account features until outstanding issues are resolved.
SECTION 12 – TAXES AND INVOICING
All transactions on the Platform are conducted in Indian Rupees (INR).

Sellers Are Responsible for Applicable Taxes
Sellers are solely responsible for determining and complying with any tax obligations arising from the sale of their Items on the Platform, including income tax, GST, or other applicable levies based on their status and location. - Business Sellers registered under GST are required to charge applicable GST (where applicable) and issue tax-compliant invoices to Buyers.
- Individual Sellers, who are not GST-registered, are not obligated to charge GST or issue tax invoices.

PurvX India’s Tax Status
PurvX India is currently not registered under GST, as it operates below the applicable turnover threshold. If and when PurvX India becomes GST-registered, GST will be charged on listing fees, commissions, and any paid services provided to Sellers. Tax invoices for such charges will be issued accordingly. -
Automated Receipts vs GST-Compliant Invoices
Upon successful purchase, Buyers will receive an automated order confirmation or transaction summary from PurvX India. This is not a GST invoice and is intended solely for order acknowledgment and recordkeeping.
If a Buyer requires a formal GST invoice, it is their responsibility to confirm that the Seller is GST-registered before placing the order. PurvX India is not responsible for issuing GST invoices on behalf of Sellers.

Buyers Are Responsible for Import Duties (if applicable)
For international orders, Buyers are responsible for any customs duties, taxes, or import fees imposed by the destination country. These charges are not included in the Item price unless expressly stated by the Seller. -
Future Changes to Tax Treatment
PurvX India reserves the right to revise this section to reflect changes in its GST registration status or changes to applicable tax laws. Any such updates will be made available on the Platform.
SECTION 13 – INTERNATIONAL SHIPPING
Sellers and Buyers engaging in cross-border transactions are responsible for understanding and complying with the applicable import and export rules in their respective jurisdictions.
1. Customs Duties and Import Charges (Buyers)
Buyers are responsible for any customs duties, VAT/GST, import taxes, handling charges, or other fees that may be levied by the destination country. These charges are not included in the listed price unless clearly stated otherwise by the Seller.
Delays caused by customs clearance are outside the control of both the Seller and PurvX India, and PurvX India is not liable for any related costs or outcomes.
2. Export Compliance (Sellers)
Sellers are responsible for complying with all applicable Indian export regulations, including:
o Proper classification and declaration of goods
o Adherence to restrictions under customs laws
o Ensuring Items are eligible for international shipping
o Any requirements under schemes such as the Duty-Free Gift Threshold (DFGT), if applicable
Sellers must use accurate documentation and reliable shipping services when dispatching Items internationally.
3. Platform Role
PurvX India does not act as an importer, exporter, or shipping agent for any international transaction. We do not provide customs clearance services, and we are not liable for losses, delays, or confiscations arising from international shipments.
SECTION 14 – RETURNS, REFUNDS, AND EXCHANGE POLICY
1. Final Sale by Default
Unless a Seller explicitly specifies a return or exchange policy in their listing, all sales are deemed final. Buyers are responsible for reading the listing details and verifying Seller return terms (if any) before making a purchase.
2. Dispute-Based Refunds
Buyers may raise a dispute and request a refund under the following circumstances:
o The Item was not delivered within the reasonable delivery timeframe.
o The Item received is counterfeit or not as described in any material way.
o The Item has significant undisclosed defects, damage, or is otherwise misrepresented.
3. Reporting Timeframe
Buyers must report any dispute within three (3) calendar days of confirmed delivery. Failure to raise a dispute within this timeframe may result in automatic order closure, and the transaction will be considered final.
4. Investigation and Resolution
Upon receiving a dispute, PurvX India will conduct an internal investigation, which may include:
o Reviewing listing content and images
o Examining buyer-submitted evidence (photos, videos, delivery status)
o Communicating with both parties for clarification
Based on the findings, PurvX India may:
o Approve a full or partial refund
o Require the Buyer to return the Item before a refund is issued
o Reject the dispute if evidence of misrepresentation or non-delivery is insufficient
5. Refund and Return Conditions
o If a refund is approved, funds will be processed within 7–10 business days after resolution.
o If a return is required, the Item must be sent back in its original condition using trackable shipping.
o Buyers may be required to bear return shipping costs unless otherwise determined by PurvX India.
6. Non-Refundable Fees
All listing fees, listing service enhancements, and platform charges are non-refundable, including in cases where the underlying transaction is reversed.
7. Abuse and Platform Enforcement
Repeated, excessive, or fraudulent refund or dispute behavior may result in:
o Account restrictions
o Withholding of payouts or refunds
o Removal from the Platform
8. Discretionary Enforcement
PurvX India retains sole discretion to approve or deny disputes and refunds, even if a return policy is not explicitly stated by the Seller. We act in good faith to balance Buyer protection with Seller accountability.
9. Policy Updates
This policy is subject to change, and the version published at the time of dispute will apply.
SECTION 15 – FRAUD, DISPUTES, AND INVESTIGATIONS
1. Zero-Tolerance Policy
PurvX India maintains a strict zero-tolerance policy toward fraud, misrepresentation, and abuse of the Platform by Buyers or Sellers. Any suspected misuse will be subject to investigation and potential enforcement action.
2. Grounds for Investigation
We may initiate an investigation in cases including but not limited to:
o Listing of counterfeit or stolen goods
o Repeated non-delivery or item misrepresentation
o Disputes over payments, item quality, or shipping
o Manipulation of reviews or platform activity
o Attempts to transact outside the Platform to avoid fees
o Use of false or misleading account or KYC information
3. Investigation Process
PurvX India reserves the right to:
o Request additional information or documentation from Buyers or Sellers
o Temporarily hold Seller payouts or freeze account access
o Suspend or terminate accounts based on the outcome of an investigation
o Share relevant information with regulatory authorities or law enforcement where required
4. Seller Payout Holds
In the event of a buyer dispute, suspected fraud, or suspicious transaction, PurvX India may place a temporary hold on the Seller’s payout. Funds will be released only after the issue is resolved or investigation is complete.
5. Consequences of Violations
Depending on the severity and nature of the violation, PurvX India may take one or more of the following actions:
o Cancel transactions or listings
o Withhold or reverse payouts
o Ban the user from creating future listings or accounts
o Take legal action or escalate to relevant authorities
o Enforce penalty fees or damages to recover losses caused to the Platform
6. No Right to Platform Access
Access to the Platform is at PurvX India’s sole discretion. We reserve the right to deny access to any User, with or without notice, if fraudulent or harmful behavior is identified.
7. Final Decision
All investigations and dispute outcomes will be determined by PurvX India in good faith, and such determinations shall be considered final and binding.
SECTION 16 – ROLE OF PURVX INDIA
1. Marketplace Intermediary
PurvX India is a digital platform that facilitates transactions between independent Buyers and Sellers of South Asian ethnic clothing, accessories, and related items. Unless otherwise explicitly stated, we do not own, sell, or take possession of the items listed on the Platform.
2. No Inventory or Custody
PurvX India does not hold inventory or store any items listed on the Platform. All listings are maintained and shipped by Sellers, and title and risk of loss transfer directly from the Seller to the Buyer upon dispatch or delivery.
3. No Guarantee of Transactions
PurvX India does not guarantee:
· The quality, authenticity, legality, or condition of any item
· That any Seller or Buyer will complete a transaction
· That item descriptions or representations are accurate
· That items will be delivered within any specific timeframe
We encourage users to review listings and seller information carefully before making a purchase.
4. Platform Moderation and Enforcement
PurvX India reserves the right to moderate platform activity, including reviewing, editing, rejecting, or removing listings or user content that violate platform rules, legal requirements, or community expectations. We may suspend or terminate user accounts at our sole discretion.
5. Legal Status as Intermediary
PurvX India operates as an intermediary under Section 79 of the Information Technology Act, 2000. We are not a party to the contract for sale between Buyers and Sellers and are not liable for any loss, claim, or dispute except as expressly set out in these Terms.
6. No Agency or Employment Relationship
These Terms do not create any agency, partnership, joint venture, or employment relationship between you and PurvX India. All Sellers operate independently and are not representatives of PurvX India.
7. Distinct Legal Entities
PurvX India is operated and owned independently from PurvX Marketplace Inc., which operates www.purvx.com. Each is a separate legal entity with distinct policies, systems, and operations.
Users who create accounts or transact on either www.purvx.in or www.purvx.com agree to be bound by the specific terms, conditions, and policies applicable to that respective platform.
PurvX India and PurvX Marketplace Inc. only share the “PurvX” brand name but are otherwise unaffiliated in ownership, operations, or legal responsibility.
SECTION 17 – INTELLECTUAL PROPERTY
1. Ownership
All content on the Platform — including but not limited to text, graphics, images, logos, icons, designs, audio clips, digital downloads, product descriptions, reviews, and software — is the intellectual property of PurvX India or its licensors and is protected under applicable Indian and international intellectual property laws.
2. Limited License to Users
These Terms permit you to use the Platform for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, store, or transmit any of the material on the Platform without prior written consent. All rights not expressly granted herein are reserved by PurvX India.
3. User-Generated Content
By uploading, posting, or submitting any content (including product images, descriptions, or reviews), you grant PurvX India a non-exclusive, royalty-free, worldwide, irrevocable, sub-licensable license to use, reproduce, display, modify, distribute, and promote such content for the purpose of operating or marketing the Platform. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe any third-party rights.
4. Use of AI and Digital Tools
PurvX India may use AI or algorithmic tools to generate content, visuals, or promotional materials for listings. These are intended for representational purposes only and may not exactly replicate real-world products. All such content remains the intellectual property of PurvX India unless otherwise stated.
5. Trademarks
The PurvX name, logo, and all related marks are trademarks or service marks of PurvX India or licensed for use. Shopify and other third-party marks referenced on the Platform are the property of their respective owners. You must not use any such trademarks without express written permission.
6. Prohibited Use
You may not:
· Copy or reuse listing images, text, or layout for commercial purposes;
· Use automated tools to scrape or reproduce Platform data;
· Impersonate or falsely associate with PurvX India or any of its affiliates;
· Use the PurvX name, branding, or IP in domain names, URLs, or promotional material.
7. User Responsibility for Infringement
Users are solely responsible for ensuring that any content, images, or materials they upload do not infringe third-party intellectual property rights. PurvX India does not proactively monitor all listings and disclaims liability for unauthorised use of IP by users. However, we take infringement complaints seriously and will investigate and take appropriate action — including removal of content or user suspension — upon receiving notice.
8. Safe Harbour Under IT Act
PurvX India operates as an intermediary under Section 2(w) and Section 79 of the Information Technology Act, 2000. We are not liable for third-party content uploaded by users, provided we act promptly upon receiving valid complaints, in accordance with law.
9. Copyright Complaints
If you believe your intellectual property rights have been violated on the Platform, you may contact us at support@purvx.in with appropriate details. We will review the claim and take action in accordance with applicable Indian law and our internal policy.
SECTION 18 – THIRD-PARTY LINKS AND TOOLS
1. External Links
The Platform may contain links to third-party websites, tools, or services that are not owned or controlled by PurvX India. These links are provided for your convenience only. We do not endorse, monitor, or have any control over such third-party content and are not responsible for the accuracy, availability, or legality of any external sites or resources.
2. Use at Your Own Risk
You acknowledge and agree that your access to and use of third-party websites, applications, or tools is at your own risk and subject to the terms and policies of those third parties. PurvX India will not be liable for any damages or losses resulting from your use of or reliance on any third-party content, products, services, or tools.
3. Optional Tools
We may provide you with access to optional third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement.
4. Responsibility for Transactions
If you choose to enter into transactions with third parties linked to or referenced by the Platform (e.g., logistics providers, payment gateways, or external service providers), such transactions are solely between you and the third party. PurvX India is not responsible for any issues, losses, or claims arising from such interactions.
5. New Features
Any new features or tools added to the Platform shall also be subject to these Terms.
SECTION 19 – ERRORS, INACCURACIES, AND OMISSIONS
1. Content Limitations
The Platform may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, delivery timelines, and availability. PurvX India does not warrant that all content made available on the Platform is accurate, complete, reliable, or current.
2. Right to Correct
We reserve the right to correct any errors, inaccuracies, or omissions at any time, without prior notice, including after an order has been submitted. This includes the right to update information, cancel orders, or revise product listings if any information on the Platform or related services is inaccurate.
3. No Obligation to Update
Except as required by law, we undertake no obligation to update, amend, or clarify information on the Platform, including pricing information. The absence of a specific update or refresh date should not be interpreted to mean that all information has been modified or is up to date.
4. No Liability for Reliance
PurvX India disclaims any liability for reliance on inaccurate or incomplete information presented by Sellers, third parties, or automated tools. Buyers and Sellers are encouraged to verify key details before transacting.
SECTION 20 – LEGAL COMPLIANCE
1. Applicable Laws
You agree to comply with all applicable Indian laws, rules, and regulations in connection with your access to and use of the Platform. These include, but are not limited to:
o The Information Technology Act, 2000
o The Consumer Protection Act, 2019
o The Consumer Protection (E-Commerce) Rules, 2020
o Indian Contract Act, 1872
o Applicable export/import laws, including the Foreign Trade (Development and Regulation) Act, 1992
o Income Tax Act, 1961 and GST regulations (where applicable)
2. Prohibited Conduct
You must not use the Platform for any unlawful purpose or in violation of any applicable law, including:
o Posting or selling prohibited items
o Uploading or sharing misleading, infringing, or fraudulent content
o Violating another person’s rights, including privacy or intellectual property
o Circumventing platform policies or payment systems
o Gaining or attempting to gain unauthorized access to any part of the Platform
3. Export Controls and International Use
If you are accessing the Platform from outside India, you are responsible for ensuring compliance with both Indian export laws and your local laws. Sellers must comply with applicable customs, duties, and documentation requirements.
4. Enforcement
PurvX India reserves the right to investigate violations and take appropriate action, including terminating access, disabling listings, reporting to authorities, or initiating legal proceedings as necessary.
SECTION 21 – LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, in no case shall PurvX India, its directors, officers, employees, affiliates, agents, contractors, licensors, service providers, or partners — or those of Shopify and its affiliates — be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any products obtained using the Services, or for any other claim related in any way to your use of the Services or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Services or any content (or product) posted, transmitted, or otherwise made available via the Services, even if advised of the possibility.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.
SECTION 22 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless PurvX India, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, service providers, and subcontractors from and against any claims, demands, liabilities, damages, losses, or expenses (including reasonable legal fees), arising out of or related to:
· your breach of these Terms or any other applicable policies or guidelines;
· your violation of any law, regulation, or the rights of a third party (including intellectual property or privacy rights);
· your access to or use of the Platform or Services;
· your listings, communications, or conduct on or through the Platform;
· your transactions or disputes with other Users;
· your failure to comply with tax obligations, including GST, customs, or export/import regulations.
PurvX India will notify you of any claim subject to indemnification. A failure to promptly notify will not relieve you of your indemnification obligations unless such failure materially prejudices your ability to defend the claim. PurvX India may control the defense and settlement of any such claim at your expense, including the choice of counsel. However, we will not agree to any settlement that imposes non-monetary obligations on you without your prior written consent (not to be unreasonably withheld). You agree to cooperate fully in the defense of any indemnifiable claims, including providing relevant information and documents.
SECTION 23 – DISCLAIMER OF WARRANTIES
The Platform and the Services, including all content, materials, products, and features made available through it, are provided on an “as is” and “as available” basis without any warranties, representations, or conditions of any kind, either express or implied.
To the fullest extent permitted by applicable law, PurvX India disclaims all warranties, including but not limited to:
· any implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement;
· any warranties regarding the accuracy, completeness, or usefulness of the information provided on or through the Platform;
· any warranties that the Platform or Services will be uninterrupted, timely, secure, or error-free;
· any warranties that defects will be corrected or that the Platform or its servers are free of viruses or harmful components.
All information presented on or through the Platform is made available solely for general informational purposes. Any reliance you place on such material is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other User.
No oral or written information obtained by you from PurvX India or through the Platform shall create any warranty not expressly stated in these Terms.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you depending on the laws applicable to you.
SECTION 24 - RELATIONSHIP WITH SHOPIFY
PurvX India is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with PurvX India. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and PurvX India, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with PurvX India.
SECTION 25 – WAIVER, SEVERABILITY, AND ENTIRE AGREEMENT
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court or authority of competent jurisdiction, such provision shall be severed from the remaining Terms, which will continue in full force and effect.
Our failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver will be effective only if in writing and signed by an authorized representative of PurvX India.
These Terms, along with our policies (including but not limited to the Privacy Policy, Seller Guidelines, Return and Exchange Policy, and Community Guidelines), constitute the entire agreement between you and PurvX India and supersede any prior or contemporaneous communications or agreements, whether oral or written.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 26 – CHANGES TO TERMS
PurvX India reserves the right to modify, update, or replace any part of these Terms and any related policies at any time, at our sole discretion. Changes will be effective immediately upon posting on the Platform, unless otherwise specified.

We may, but are not obligated to, provide individual notice of material changes. It is your responsibility to review these Terms periodically for any updates. Your continued use of the Platform following the posting of changes constitutes your acceptance of those changes.

SECTION 27 – PROHIBITED USES
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:
1. To violate any applicable laws or regulations, including but not limited to the Information Technology Act, 2000, the Consumer Protection Act, 2019, or any applicable export/import laws;
2. To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
3. To impersonate or misrepresent your identity, affiliation, or authority;
4. To harass, defame, abuse, threaten, intimidate, or discriminate against any individual or group;
5. To upload or transmit any false, misleading, or fraudulent information;
6. To list, promote, or sell any prohibited or restricted items as defined in our policies or applicable law;
7. To list or solicit transactions involving counterfeit goods, stolen goods, or any items that infringe upon intellectual property;
8. To gain unauthorized access to any account, system, or network connected to the Platform;
9. To introduce malicious code, viruses, or any other harmful software or material;
10. To interfere with or attempt to interfere with the proper functioning of the Platform or any transactions conducted through the Platform;
11. To collect or track the personal data of other users without consent;
12. To circumvent or attempt to circumvent any Platform security or content-filtering features;
13. To exploit, scrape, crawl, or data-mine the Platform for commercial gain without authorization;
14. To use the Platform or its Services for any commercial resale or promotional activities not expressly permitted by PurvX India;
15. To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material, including any “junk mail,” “chain letters,” “spam,” or other forms of solicitation;
16. To use the Services in a manner that restricts or inhibits any other user’s enjoyment or use of the Platform, or that may harm PurvX India, Shopify, or any of its users, affiliates, or partners.
PurvX India reserves the right to suspend, restrict, or permanently disable your account or listings, and to report violations to appropriate law enforcement or regulatory authorities, if any prohibited conduct is suspected or confirmed. Violations may also result in civil or criminal liability.
SECTION 28 – TERMINATION
PurvX India may suspend, restrict, or terminate your access to the Platform or any part of the Services, without notice, at its sole discretion, if you violate these Terms, any Platform policy, applicable law, or if your conduct is deemed harmful to PurvX India, its users, or the public interest.
Upon termination:
· Your right to access or use the Services will immediately cease;
· Any pending transactions may be cancelled at our discretion;
· You will remain liable for all amounts due up to and including the date of termination;
· We may retain or delete your content or data as permitted by law and our Privacy Policy;
· Termination does not affect your obligation to comply with these Terms for past conduct.

SECTION 29 – GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India.
For all claims, disputes, or proceedings arising from or relating to the Platform or these Terms, you agree to submit to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, and waive any objection to such venue, including on the basis of forum non conveniens.
You agree that any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
SECTION 30 – PRIVACY POLICY
All personal information we collect through the Services is subject to our [Privacy Policy], which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and agree to the terms of our Privacy Policy.
Because the Platform is hosted on Shopify, certain information you provide or that is collected through your use of the Services may be processed by Shopify in accordance with its own privacy policy, available at Shopify. Shopify collects and processes information to enable and support the delivery of the Services, and such data may be stored or transferred outside India depending on Shopify’s infrastructure and third-party service providers.
Information you submit may be shared with Shopify, our service providers, and other third parties where required to operate, improve, or provide the Services, including payments, logistics, and customer support. Some of these third parties may be located in countries other than your country of residence, and by using the Services, you consent to such international transfers as necessary.

SECTION 31 – FEEDBACK
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant PurvX India a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use. We may use our rights under this license to operate, provide, evaluate, enhance, improve, and promote the Services and to perform our obligations under these Terms.
You represent and warrant that:
· You own or have all necessary rights to the Feedback;
· You have disclosed any compensation or incentives received in connection with the Feedback;
· Your Feedback complies with these Terms and applicable laws.
You agree that your Feedback:
· Will not violate any third-party rights, including copyright, trademark, privacy, or personality rights;
· Will not contain defamatory, unlawful, or obscene content, or any viruses or malware;
· Will not be submitted using false identities or misleading representations.
We are under no obligation to (1) maintain Feedback in confidence, (2) pay compensation for Feedback, or (3) respond to Feedback. We may, but are not obligated to, monitor or remove Feedback that we determine to be objectionable or in violation of these Terms. You are solely responsible for the accuracy and legality of any Feedback you submit.
SECTION 32 – ASSIGNMENT
You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent. Any such attempt will be null and void. PurvX India may transfer, assign, or delegate these Terms and its rights and obligations without notice or consent.
SECTION 33 – HEADINGS
Headings used in these Terms are for convenience only and will not affect the meaning or interpretation of any provisions.
SECTION 34 – PLATFORM ENFORCEMENT AND COOPERATION
Users agree to promptly cooperate with any investigation, inquiry, or request initiated by PurvX India, including by providing any required documentation or information.
Payouts to Sellers may be withheld until disputes are resolved or investigations are complete.
Repeated violations of our policies, Community Guidelines, or applicable law may result in account suspension or termination.
PurvX India cooperates with law enforcement and regulatory authorities, including in matters involving fraud, counterfeit goods, or intellectual property infringement.
